A designated-agent registration is one of the requirements for certain DMCA safe harbors. Registration alone does not guarantee protection; the other applicable statutory requirements must also be satisfied.
If you believe material available through Peel infringes your copyright, send a written notice that includes:
1. Your physical or electronic signature, as the copyright owner or a person authorized to act on the owner's behalf;
2. Identification of the copyrighted work, or a representative list if multiple works at a single online site are covered;
3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, such as a source URL, Peel Code, recipe title, or relevant screenshots;
4. Contact information reasonably sufficient for us to reach you, including your address, telephone number, and email address, if available;
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.
Copyright registration numbers and screenshots can help us assess a notice, but are not required if your notice otherwise satisfies the DMCA. Trademark complaints are distinct from DMCA copyright notices; contact us by email about other intellectual property concerns.
When we receive a notice that substantially complies with the DMCA, we act expeditiously to remove or disable access to the material claimed to be infringing and take reasonable steps to notify the affected user. We may provide the notice, including the sender's contact information, to that user.
If a notice is incomplete, we may request the missing information. Where the DMCA requires it, we will contact the sender or take reasonable steps to assist in completing the notice. We assess notices on their substance, including notices submitted using automated tools; automated submission alone is not a reason for rejection.
If material you provided was removed or disabled by mistake or misidentification, you may send a written counter-notice containing:
1. Your physical or electronic signature;
2. Identification of the removed material and where it appeared before removal or disabling;
3. A statement under penalty of perjury that you have a good faith belief that removal or disabling resulted from mistake or misidentification;
4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located. If your address is outside the United States, consent to jurisdiction in any judicial district where Klip Studio LLC may be found. You must also state that you will accept service of process from the original complainant or their agent.
Send counter-notices to the designated agent above. A counter-notice contains personal information and will be forwarded to the original complainant.
When we receive a counter-notice that satisfies the DMCA, we promptly send a copy to the original complainant and inform them that we will restore the material in 10 business days. We restore access not less than 10 and not more than 14 business days after receipt of the counter-notice, unless our agent first receives notice that the complainant has filed a court action seeking to restrain the user from infringing activity relating to that material.
We terminate, in appropriate circumstances, accounts of users who repeatedly infringe copyright. We consider relevant notices, counter-notices, and the circumstances of each case. We may suspend or terminate an account for serious infringement without waiting for a fixed number of notices. A terminated user may not create a replacement account to evade this policy.
A list of ingredients and the underlying method of preparing food are generally not protected by U.S. copyright law. Original photographs, videos, expressive recipe instructions, commentary, and original compilations may be protected. Whether a particular use is permitted depends on the content and circumstances; personal use, attribution, or changing a recipe's format does not automatically establish fair use or permission.
Peel can import, store, and share recipe text and images. Importing content through Peel does not grant rights in third-party material. You are responsible for ensuring that your imports and sharing comply with applicable law and source-platform terms. See our Terms of Service.
Knowingly making a material misrepresentation in a copyright notice or counter-notice may expose you to damages, costs, and attorneys' fees under 17 U.S.C. ยง 512(f). Consider obtaining legal advice if you are unsure about your rights or obligations.
We may update this policy and will change the date at the top when we do. For questions or notices, contact:
